General Terms and Conditions of Business
1. At www.kinderhotels.com Kinderhotels Europa Management und Marketing GmbH offer a voucher system for the purchase of vouchers for Kinderhotels Europa. Vouchers can be ordered via this website and subsequently redeemed at the partner hotel in question.
2. Procedure
a) Kinderhotels vouchers, available from www.kinderhotels.com, are payable to Kinderhotels Europa Management und Marketing GmbH and can be purchased by the customer printing out the voucher using the voucher system and paying by credit card or direct transfer online.
b) The vouchers are valid only after payment in full has been received. The voucher value excludes value-added tax; this is only taken into account when the voucher is redeemed at the partner hotel. The vouchers ordered or purchased cannot be redeemed for cash.
c) The customer must book a break or holiday and redeem the voucher direct with the partner hotel in question. The hotels have secure access to the voucher system and are thus able to call in the vouchers purchased by the customer and validate them direct by means of the bar code printed on them.
d) Only the value of the vouchers can be charged to the marketing organisation; any consumption which exceeds the voucher’s value must be settled direct between the customer and the partner hotel in question. If the voucher value is not used in full, the customer will retain the balance on the voucher for use in the corresponding partner hotels. The marketing organisation will not refund the balance remaining.
e) People over the age of 18 are entitled to order vouchers.
3. Return
A voucher can be returned if posted back to Kinderhotels Europa Management und Marketing GmbH by recorded delivery post within 14 days of purchase and if a booking has not yet been made. When Kinderhotels Europa Management und Marketing GmbH has received the voucher it will credit the value to the account notified by the customer. Only customers who are consumers within the terms of the Austrian Consumer Protection Act (Konsumentenschutzgesetz) can make use of the right of return.
4. Validity
Vouchers are valid for three years from the date of purchase. Only Kinderhotels Europa Management und Marketing GmbH can extend the period of validity.
5. Liability
Kinderhotels Europa Management und Marketing GmbH accepts no liability for redemption of vouchers ordered; it is incumbent upon the hotel in question to redeem vouchers. The Customer uses this website at the customer’s risk. The marketing organisation accepts no liability for losses incurred as a result of use of this website. Kinderhotels Europa Management und Marketing GmbH also accepts no liability for disruption, technical breakdowns, maintenance work, etc. The marketing organisation will rectify disruptions or loss of service as quickly as possible.
6. Data protection
Kinderhotels Europa Management und Marketing GmbH complies with the Austrian Data Protection Act. The marketing organisation also declares that it will treat as confidential details supplied to it by the customer and that there is no legally permissible reason for transmission or disclosure of the details entrusted to it or to which it has access. When paying by credit card, details such as credit card number, bank sort code, account number, name and address are transmitted via a secure SSL connection. Your details are processed by computer. You will only receive marketing and advertising information from Kinderhotels Europa Management und Marketing GmbH.
7. Jurisdiction
It is agreed that Austrian law will apply to any disputes arising from this agreement and that the court in Klagenfurt will have sole jurisdiction.
